Can you sell shirts that quote or reference Cult Movies?
I am interested in selling novelty / Funny Tees and after searching around online I see the popular sites selling t-shirts that reference the cult films fun. As a reporter, "I'm kinda a big deal" and the popular song "I'm On A Boat." I've even seen sites that use fictional logos used in the actual movies as "Callahan Auto Parts" from the movie Tommy Boy, or "Bayside Tigers" of the television series Saved by the bell. Is this considered infringement or fair use? I note that these sites no mention of current movies or TV shows but do not put them on a television or movies section of their sites. Thanks for any help and / or advice.
The creators of the shirt most likely pay a fee for the use of quotes. The sample are copyrighted, and I guess the script individual lines are covered by the author himself. Look closely the next time you see one, and you may notice a TM or an R with a circle after appointment. But again, I am not a lawyer, nor do I play one on TV, so what do I know??
